New Hampshire Attorney General John Formella announced his office has filed a civil complaint against Southers Construction, Inc. and its owner, Ricky Southers, under the state’s Consumer Protection Act.
Southers Construction allegedly took deposits for new-build homes from 17 different customers from New Hamsphire, Maine and Massachusetts, but “performed little or no work, did not refund the customers, and consistently misled them about the status of their projects and refunds.”
Instead, Formella’s office claims, Southers Construction used these deposits to finance company operations and to move other projects along “in order to stave off financial collapse,” his office said in announcing the suit this month.
In total, the customers allegedly are out over $500,000.
The state is asking the court to bar Ricky Southers from owning or operating a construction business in New Hampshire, along with civil penalties and restitution payments.
